Please read these Terms of Service carefully before using wChatFlowAI. They form a legally binding agreement between you and Aryan Tech World Pvt. Ltd.
1. Acceptance of Terms
By accessing or using wChatFlowAI ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including individuals, businesses, agencies, and enterprises.
2. Description of Service
wChatFlowAI is a WhatsApp Business automation SaaS platform operated by Aryan Tech World Pvt. Ltd. (GSTIN: 07ABCCA5259P1Z6). The Platform provides AI auto-reply, bulk messaging, automation workflows, smart inbox, and GST-compliant billing via Meta's official WhatsApp Business API.
3. Eligibility
You must be at least 18 years old and have the legal authority to bind a business entity to these terms. By registering, you represent that the information you provide is accurate and that you will maintain its accuracy.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, all activities under your account, ensuring your use of the Platform complies with Meta's WhatsApp Business API policies, and ensuring compliance with applicable Indian law, including the IT Act, 2000 and DPDP Act, 2023.
5. Acceptable Use
You agree not to use the Platform to send spam, unsolicited messages, or content that violates Meta's messaging policies; distribute malware or harmful content; violate any applicable law including anti-spam regulations; or reverse engineer, copy, or resell the Platform without written authorization.
6. Billing & Payments
Subscription fees are billed monthly or annually in Indian Rupees (INR) and are exclusive of 18% GST, which is added at checkout. All payments are processed via Razorpay. Plans auto-renew unless cancelled before the renewal date. We offer a 14-day money-back guarantee on BYO subscription plans. Managed Wallet top-ups are non-refundable.
7. Service Availability
We target 99.8% uptime (excluding scheduled maintenance). Planned downtime will be communicated 24 hours in advance. We are not liable for downtime caused by Meta/WhatsApp API outages, third-party infrastructure issues, or force majeure events.
8. Data Ownership
You retain full ownership of your data, contacts, and message content. By using the Platform, you grant wChatFlowAI a limited license to process your data solely to provide the service. We do not claim ownership of your WhatsApp conversations or contact lists.
9. Termination
Either party may terminate the account at any time. We may suspend or terminate accounts that violate these terms, Meta's policies, or applicable law without prior notice. Upon termination, your data will be retained for 30 days before deletion, during which you may export it.
10. Limitation of Liability
wChatFlowAI's total liability for any claim is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India. We encourage resolving disputes informally first — contact [email protected].
12. Changes to Terms
We may modify these terms at any time. We will notify you via email at least 14 days before changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised terms.
